CALGARY The provincial NDP says it is moving to amend the Constitution to legalize same-sex marriage in Saskatchewan because of its own laws, CBC News reported Tuesday.

The NDP said it filed the request to change the federal Constitution on Thursday and says it would appeal it to the constitutional court.

There is a right to same-sex parenting within our province, said NDP Leader Andrea Horwath. The legal status of marriage has changed over the past 40 years, but in Saskatchewan we still have the option to define marriage as between a man and a woman.

Horwath said her party is confident that it will prevail, and added that she has sent a letter asking for her to intervene in a vote on the matter.

She said her party is working on the issue to support our future, even as Saskatchewan moves forward on marriage. We are working to amend and pass legislation to expand our legal rights in Saskatchewan and recognize that it is legal.

The NDP is asking the Supreme Court to determine if all federal amendments to the Constitution will affect their bill.

Previous versions of the bill, which would ban same-sex marriage throughout Saskatchewan and criminalize it, had included provisions such as requiring parents to apply for marriage licenses for any adult in the province who wished to do so.

While provinces that have same-sex marriage bans have been successful over the past few years in challenging the law in court, Horwath said the federal government has always done a better job of protecting rights of all Ontarians.

She said she’s hopeful the Supreme Court, with a majority voting no, will overturn the federal constitution on July 30. Horwath said she expects the Supreme Court to weigh in on Canada’s marriage Bill on July 30 in order to determine what can and cannot be changed with changes to the law.
